Terms of Service

Chapter 1: General Provisions

Article 1 (Purpose)

These terms and conditions set forth the terms, conditions, and procedures for the use of Huemaner services (hereinafter referred to as the "Services") operated by Huemaner Inc. (hereinafter referred to as the "Company"), as well as other necessary matters. By agreeing to these terms, users can utilize the services without entering into separate agreements.

Article 2 (Definitions)

The terms used in this agreement are defined as follows:

  1. Website: The website host name herlish.com operated by the Company to provide the Services.

  2. Member: Any individual who enters into a service agreement with the Company and uses the Services provided.

  3. ID: A combination of letters and numbers selected by the Member and approved by the Company for identification and service use.

  4. Password: A combination of letters and numbers selected by the Member to protect their privacy during communication.

  5. Content: All symbols, letters, sounds, videos, images, and other materials provided by the Company or created using the Services, including Member-created outputs.

  6. Paid Services: Features within the Services that require payment.

Article 3 (Effectiveness and Changes of Terms)

  1. The Company shall make these terms easily accessible on the service's main page for Members to view. The terms may also be accessible through linked pages.

  2. The Company may amend these terms within the bounds of relevant laws such as the Consumer Protection Act in E-commerce, Regulations on Standardized Contracts, and other applicable laws.

  3. When amending the terms, the Company will specify the application date and reasons for the change and notify Members at least 7 days prior to the effective date. For changes unfavorable to Members, a 30-day notice will be provided.

  4. If a Member does not explicitly express their intention to terminate the agreement by the effective date, they are deemed to have agreed to the amended terms.

  5. Any matters not specified in these terms or their interpretation shall follow relevant laws and customary practices.

Chapter 2: Membership Agreement

Article 4 (Membership Registration and Management)

  1. The service agreement is established when an applicant agrees to these terms and submits a registration form, and the Company approves the application.

  2. Applicants must use their real names and accurate information. Each individual is allowed only one membership registration.

  3. The Company is not responsible for any disadvantages arising from using false or inaccurate information.

  4. Members must promptly notify the Company of any changes in their registration information.

Article 5 (Approval and Restrictions on Membership Applications)

  1. The Company may delay approval under the following circumstances:

    • Insufficient system capacity or technical issues.

    • Other circumstances that the Company deems necessary.

  2. Membership may be denied in the following cases:

    • Using another person’s identity.

    • Submitting false information.

    • Violating public order or moral standards.

    • Previous membership was terminated due to terms violations within the past year.

Chapter 3: Rights and Obligations of Parties

Article 6 (Company Obligations)

  1. The Company shall provide continuous and stable Services as per the agreement, except in unavoidable circumstances.

  2. The Company shall maintain appropriate security measures to protect Members' personal information.

  3. The Company will address legitimate complaints and suggestions from Members promptly.

Article 7 (Member Obligations)

  1. Members must adhere to these terms, company notifications, and service guidelines.

  2. Members are prohibited from the following:

    • Providing false information during registration or updates.

    • Sharing their account or accessing another's account without authorization.

    • Using automated tools to exploit the Services.

    • Infringing on the intellectual property rights of the Company or third parties.

    • Posting content that is violent, obscene, discriminatory, or violates laws and company policies.

Chapter 4: Service Use

Article 8 (Service Availability)

  1. The Services are available 24/7 unless technical or operational issues arise.

  2. The Company may impose restrictions on device types or the number of devices accessing the Services.

  3. Members must comply with the Company’s Fair Use Policy (FUP):

    • Abuse of the API, account sharing, or excessive use will lead to restrictions or termination.

Article 9 (Paid Services)

  1. Paid Services may include subscription plans, additional features, or one-time purchases. Specific terms for Paid Services will be disclosed separately.

  2. Refunds or cancellations for Paid Services are governed by applicable laws and service-specific policies.

Chapter 5: Intellectual Property and Ethics

Article 14 (Copyright and Ownership)

  1. All intellectual property rights to materials and outputs generated through the Services belong to their respective creators, unless otherwise specified.

  2. Members grant the Company a non-exclusive license to use uploaded or generated content for service operation, improvements, and promotional purposes.

Article 19 (AI Ethics Policy)

  1. The Company prioritizes ethical AI practices to ensure accuracy, impartiality, and privacy protection.

  2. Members agree to use the AI Services responsibly and must report unethical or harmful outputs to the Company for improvement.

Chapter 6: Miscellaneous

Article 22 (Liability and Indemnification)

  1. The Company and Members are liable for damages caused by breaches of these terms unless proven otherwise.

  2. The Company is not liable for the following:

    • Service interruptions due to force majeure or Member negligence.

    • Misuse of the Services leading to third-party disputes.

    • Free Services and unintended outcomes of AI-generated results.
